Kicked Out of Condominium by Lying Filipinos

I’m renting a unit in a condominium for more than one and a half years already and so far everything has been good. The owners of my unit seemed to be ok, and when my contract expired after one year, they told me i could just stay there without a contract and just let them know on a monthly basis if i wanted to stay for another month.

Last month they told me their aunt will move into the unit i’m renting, but they would give me until the end of January 2014 to move out. I said alright, i’ll try to move out as soon as possible and that i would let them know as soon as i had found something. I thought it is completely obvious that if i don’t tell them i’m moving out earlier it means i didn’t find a place and i will stay until the end of January.

Yesterday i received a text message from the owners of the condo telling me their aunt will move in on Monday, January 6 2014. I replied i haven’t found a new place yet so i’d like to stay the rest of the month. They said it is not possible because their aunt is already in Cebu and she will move in there and they insisted they told me i have to move out until the beginning of January.

At this point i got really annoyed, i told them this was a blatant lie and forwarded the message in which they told me i had time until the END of JANUARY. It took them a while to reply and when they did they said this was not true and they don’t know where i got this from, someone else must have written this message. WTF???? How stupid do they think i am???? How can you deny something so obvious????

Filipinos Are HypocriteAnyway, it seems like i have no choice but to find a new place within a few days. Fucking idiots. I told them i expect my deposit back one the exact day i’m moving out.

A little bit off topic, but the most annoying thing is that they end every fucking message by saying God Bless. God bless here god bless there, while trying to screw me over, what fucking hypocrites.

Be   it   enacted   by   the   Senate   and   House   of   Representatives   of   the   Philippines   in   Congress assembled:

SECTION 1. Short Title. – This Act shall be known and cited as the “Rent Control Act of 2009.

SEC. 9. Grounds for Judicial Ejectment. – Ejectment shall be allowed on the following grounds:

(c) Legitimate need of the owner/lessor to repossess his or her property for his or her own use or for the use of any immediate member of his or her family as a residential unit: Provided, however, That the lease for a definite period has expired: Provided, further, that the lessor has given the lessee the formal notice three (3) months in advance of the lessor’s intention to repossess the property and: Provided, finally, that the owner/lessor is prohibited from leasing the residential unit or allowing its use by a third party for a period of at least (1) year from the time of repossession;

    This sounds oh so typical of the average Filipinos shit-for-brains. You can show them proof, show them on your phone that the text came from THEIR OWN NUMBER, and they’ll still deny and cast blame on someone else, no matter how ridiculous it is.

    So what they’re saying is, someone stole their phone, randomly texted you that you can stay till the end of January, giggled, then put the phone back. What motivation would anyone have to do such a thing??? WHAT A FUCKING IDIOT!!!

    Fortunately for you, THEY ARE WAAAAYYYYYY OUTSIDE OF THE RENTAL LAWS HERE IN PHILIPPINES. They cannot kick you out because their aunt wants to move in right away. IT’S AGAINST THE LAW. But how very typical of the DUMBFUCK FILIPINO to be so ignorant of the law.

    Don’t worry, I would immediately inform them they are in violation of the law as well as your rental agreement. I would get your rental agreement and read the part where they are supposed to give you 3 MONTHS NOTICE if they want you out of there. And tell them you WILL NOT LEAVE, UNTIL YOU RECEIVE, AS STATED IN THE RENTAL LAWS, A WRITTEN NOTICE FROM THEM THAT YOU MUST VACATE THE UNIT WITHIN 3 MONTHS. If not, threaten them with court. There is NO WAY they can legally evict you for the reasons they are stating.

    Show them the law:

      Your contradicting yourself when you mentioned “IT’s The Law”

      It’s a well known fact that the vast majority of the Filipinos here in PH could give a “FLYING FUCK” about the rules.

      If Danny is a foreigner and the landlord decides to take legal action who the fuck do you think the court with side with, the foreigner!!!

        Good point. I knew an American who loaned money to a Filipino and the Filo put his farm up as collateral, signed over to the American’s Filipina wife. All legal and notarized. Farmer reneged on the loan and my friend sued. Court declared that the fact the Americano was in the right 100% notwithstanding, the american is rich and can afford to lose the money and the poor Filipino needs his farm and should never have been loaned the money (for an operation to save his wife or something) and so the fault lies with the greedy Amerikano. thus while the law says the farmer should hand over his land to the Americano( or his wife) the court has ruled against that and in favour of the poor, exploited Filipino. I kid you not.
        I can cite more cases, even provide the details if you wish to check. Case after case of the court finding in favour of the Filipino. I know a Brit who is into his 5th year in jail awaiting final hearing for trumped up charges., 24 of 25 have been beaten or dropped/dismissed but one remains and because the pride of the judge and the prosecutor is at stake if he is found innocent, he is being stuffed around month after month. Best advice, get the flock outta there.

    The thing is, you have possession and possession is 9/10ths of the law, even in The Land of Lip Service. You will never see a centavo of your security bond unless you hold something of theirs, like the aunt. Every excuse under the sun will be offered but you will never see a peso… unless you have collateral. God Bless… just getting in a little two-faced Filipino pinheadedness meself there…

    Do not give in. Tell them you need your security deposit to pay for the new place and removals… the sooner they give it all to you the sooner you can move out.

    Invite aunty to stay with you in the spare bedroom, but at a discount rate for the rent.

    Basically, they are the ones with the problem, not you. I would be wary leaving in case they change locks and throw your stuff out, but that can be gotten around. I would say come over now and bring my security deposit so I can pay the new landlord and you can tell him I am a good tenant. Then when they arrive, get the cash and then tell them the other landlord did a Filipino on you (God Bless) and reneged so you now have to stay a little longer. Then put it to them to find you a new place under the Lima Law for squatters, hahahaha.

    Whatever you do, once you vacate you have no leverage and you will never see your deposit ever again. Oh, don;t pay the bills, they go with the address, not the individual so if you don;t pay then they will have to to get electric and phone back on hahahahahahahaha

      Well said Perry. Although I would never invite aunty to stay. All the rights and laws are on Danny’s side. FUCK THEM, and their aunty too! I would be changing the locks so they don’t have a copy of the key. And I would make sure I stay there up to the very last day of the 3 month notice.

      And you’re right on the deposit. I have relocated 4 times within Philippines, and have NEVER received a peso of my deposit back, ever. Consider that GONE!

      Damn Filipinos are such pieces of SHIT.

        The problem is not that they don’t, collectively and individually, have integrity. It is that they don;t have it in the same way we do. They have a very different concept of these things to us, as do many non-Anglo cultures and if you were raised in the USA, regardless of ethnic origins you are for the most part ‘anglo-cized’.

        We see being honest and direct as positive traits. They see them as insulting and risky. They are more selfish and less altruistic and when you think for the most part as an Asian you are one in a couple of billion who all look alike and have very little to set yourself apart from everyone else, living cheek by jowl. Unless you are wealthy, high-born, connected etc.

        Why keep your word when it is no longer to your advantage to do so? Doesn’t make sense. Why put a stranger (and especially a foreigner) ahead of your family, friends, self and anyone who is more powerful or can help you? What will you gain from keeping your word if there is no stigma attached in your mind or culture to breaking it? If people respect you(fear you) because you are mean, nasty, tough etc why be nice? When it is your turn to suffer no doubt you will but until then, make the other suffer. That is their karma, their path in life and far be it for you to affect it, even for the good. hence people stand around watching traffic accident victims die or kids drown etc.

        The best advice is to either accept it and play it their way; or leave. Obviously you can;t leave or else by now you would have done as I did and got the flock out of there. So the only solution is to adjust your expectation to the reality (fucked up beyond all belief [FUBAB] as it is). It works for them but keep in mind most have an IQ of 86 and the rest have money or connections. See? Works like a charm!

          I read somewhere that the average IQ is actually lower than 86 here.

          Boarding my plane to lovely Virginia in a few hours and working overseas a few months. I get to come back to Shitlippines in May (might push it back to June) and hopefully get some birth certificates/passports for the newborn babies in a speedy manner. The plan once I get here is to plan to get the hell out with family right behind… moving to Florida 🙂

          There is much wisdom in your words Perry. I do realize this. And I do apply what you say in my daily life here.

          But this blog is the only place we can really keep the “anglo-cized” (or what I like to call “common-fucking-sense”) parts of us fed and nourished. I shudder at the thought of fully adapting in the deepest parts of my mind to their “ways”.

          So PFB is were we can live in Philippines, and remain “anglo-cized”.

        After 4 re locations and not once got it back? Ok problem solved for me, if I don’t get my deposit back, I’m gonna makes sure that deposit is put to good use. The deposit is used for repairing any damages that has been done to the unit after leaving. If I don’t receive my deposit, gonna invite all my classmates over (and any member here on if you want) and have a big party, and totally destroy this fuckin place to the point where they would have to use very centavo of my deposit to restore the unit back to normal. Hopefully they can’t claim any legal cases against me if I do that 🙂

          well, after the 2nd time not getting my deposit back, anytime I plan to move, I do put my deposit to good use. According to rent law, you pay 1st month, last month, and security deposit equivalent to 1 month’s rent.

          The last two times I moved, I gave 60 days notice. At that point, I never pay another peso for rent, and I consume the last month rent and security deposit as rent for my final two months of stay there. I play their game by offering that I will pay the final month “next week” and string them along. Then at the end of the 60 days, my truck shows up, I load up my shit, and I’m outta there.

          Break everything you can in that condo, cancel cable tv and do whatever you can to make the owners of that condo regret ever having rented it to you. and dont worry about the legal case against you, it will take decades for it to get to court, and play the game, take pics with a cam where you set the date to the time of you moving in and use it as proof in their so called courts that this was the state of the condo WHEN you moved in. IQ86 LOL that should be easy to trick, taunt and beat anyday.

    I can’t tell you how many times I’ve had a Dumbshit Filipino deny what they said to me by text, and when you forward it to them to prove it, they really believe that all they have to do is continue to deny it, and somehow that erases the indisputable documented proof of what they said.

    Filipinos have NO INTEGRITY WHATSOEVER. The reduce themselves to lower than a worm, rather than to be man enough to admit what they did or said. They have no self respect or dignity whatsoever. I don’t think they even know the meaning of the word.

      Filipinos are taught to “hear” and not “see.” They “SEE” that they live in a shitty country, but they refuse to believe it because they are “HEARING” everyone around them saying how great this country is. They don’t use their eyes, they rely on sight alone and pretend they can’t see a goddamn thing! That’s why some of these Filipinas gets married to some of these low-life scumbags from foreign countries who are 3 times older than them.     Thanks guys, for some good advice here. The whole thing turned out to be a blessing for me, a friend found a very good 3 BR house with swimming pool and it’s cheaper than this 1 BR Condo as well. However i told them i will move my stuff out after i have received my deposit and not one second earlier. Let’s see what happens tomorrow, i’m sure they can find a way to misunderstand this.

    My take on the “Rent Control Act of 2009” is that it only covers properties of relatively low rental value, and thus a lot of expats would be excluded from the protections afforded under the Act.

    SEC. 5. Coverage of this Act. – All residential units in the National Capital Region and other highly urbanized cities, the total monthly rent for each of which ranges from One peso (P1.00) to Ten thousand pesos (P10,000.00) and all residential units in all other areas, the total monthly rent for each of which ranges from One peso (P1.00) to Five thousand pesos (P5,000.00) as of the effectivity date of this Act shall be covered, without prejudice to existing contracts.

    The Act appears to be drafted in true Pinoy style (complete with spelling errors) and fails to spell out so many things in a clear fashion, that enforcement through the courts would most probably be a nightmare for both landlords and tenants.

    As you’ve observed before FiloFail, the laws in the Philippines are much like ornamental fruit – they look good – but serve no useful purpose whatsoever. Looks like the “Rent Control Act of 2009” is just one more example of that.

      You’ll get no argument from me CyberGod. All you speak is the obvious truth. But what I mean is, Filipino’s are essentially gutless turds. Therefore, it’s easy to show them a paragraph of the law, then tell them you know your rights, and you better not fuck with me or you’ll loose your ass, they cower. It worked for me once. Might not work for everyone, but it’s worth a try.

      But I like what CebuBear said, possession is 9/10’s of the law, and even where there is no law, they should know they are not going to get you out with the backing of the law as well. So if you’re in possession, you’re holding the vast majority of the cards. So play them.
